Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Cuena desktop application and related hosted services (together, the “Service”), operated by the Cuena team. By creating an account or using the Service you agree to these Terms.
1. The Service
Cuena is a desktop assistant that can capture on-screen and audio context to produce real-time notes, summaries, and AI answers. You may run it fully locally with your own AI provider keys, or use our hosted, credit-based AI service.
2. Accounts
Some features require an account, created via Google or GitHub sign-in. You are responsible for activity under your account and for keeping your sign-in secure. You must be at least 18 years old, or the age of majority in your jurisdiction.
3. Acceptable use
You agree not to use the Service to break the law, infringe others’ rights, record or capture people without any consent required where you are, or attempt to disrupt or reverse-engineer the Service. You are responsible for ensuring your use of screen and audio capture complies with the laws and consent requirements that apply to you.
4. Plans, billing, and credits
Paid plans and credit packs are described on our Pricing page and are billed in USD through our payment provider, Creem. Subscriptions renew automatically until cancelled. Managed AI usage consumes credits; when credits run out, managed requests are declined until you top up, renew, or switch to your own API key. Cancellation and refunds are covered by our Refund & Cancellation Policy.
5. Your content
You retain all rights to the content you capture and create. In local mode, that content stays on your device. When you use hosted features, the minimum content needed to fulfil a request is sent to our service and the relevant AI provider to generate a response. See our Privacy Policy for details.
6. Disclaimers
The Service is provided “as is” without warranties of any kind. AI output can be inaccurate or incomplete; do not rely on it for legal, medical, financial, or other professional decisions without independent verification.
7. Limitation of liability
To the maximum extent permitted by law, Cuena is not liable for any indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid for the Service in the 12 months before the claim.
8. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms.
9. Changes
We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above.
